  • Fees for services will be as outlined at the time of purchase or as otherwise agreed in writing.

  • Payments must be made in U.S. Dollars and in accordance with the schedule outlined in the applicable Agreement.

  • All payments are final and non-refundable. Chargebacks are prohibited and subject to penalties.

5. Client Responsibilities

You agree to:

  • Provide timely access to information, resources, and personnel needed for us to deliver services.

  • Use our services only for lawful purposes and not share deliverables or proprietary tools with unauthorized third parties.

  • Accept that success is not guaranteed and that implementation and results are your sole responsibility.

6. Intellectual Property & Confidentiality

  • All proprietary information, tools, and materials we provide remain our exclusive property.

  • You may not copy, distribute, reverse-engineer, or make our proprietary information available to third parties except as expressly authorized.

9. Marketing & Remarketing

By providing your email or using our website, you consent to receive marketing communications and targeted ads. You may unsubscribe or opt out at any time (see Privacy Policy for details, including Google, Meta, and Bing opt-out settings).

10. Communications Consent

By providing your email or phone number, you consent to receive communications from us via email, SMS/MMS, and phone calls (including autodialed or prerecorded calls) about services and promotions.

12. Limitation of Liability

To the maximum extent permitted by law, The Agency Engineer LLC and its owners, officers, employees, contractors, members, freelancers, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of the website or our services, even if we have been advised of the possibility of such damages.

In no event shall our total liability for any claim arising out of or relating to these Terms, the website, or the services exceed the greater of:

  1. One hundred dollars ($100), or

  2. The total amount you paid to us for the services giving rise to the claim in the three (3) months preceding the event.

You agree to indemnify, defend, and hold harmless The Agency Engineer LLC, its owners, members, officers, employees, contractors, freelancers, and affiliates (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  3. Your breach of these Terms;

  4. Your violation of any applicable law, regulation, or third-party right; or

  5. Any claim brought by a third party as a result of your actions or omissions.

This obligation applies to all claims, whether direct, indirect, consequential, or incidental, even if we have been advised of the possibility of such damages. You assume all risks associated with the use of our services, and acknowledge that all statements we make are expressions of opinion and not representations of fact.

We may suspend or terminate your access at any time for violation of these Terms or if we deem your conduct disruptive or harmful to our business. You remain responsible for outstanding payments.

15. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of Wyoming.

  • Any disputes shall be resolved exclusively in courts located in Miami, Florida.

  • Arbitration and confidentiality provisions in the Consulting Services Agreement apply.

16. Testimonials & Marketing

By engaging with us, you grant us permission to use your name, likeness, and testimonial statements in our marketing and promotional materials, as outlined in the Agreement.

17. Disclaimer of Typical Results

You acknowledge and agree that marketing, advertising, and consulting services inherently involve risk. Results are not guaranteed, and past performance does not represent future outcomes. While we strive to provide quality strategies and services, results are not typical, and success depends on numerous factors outside of our control (including your business model, market conditions, and execution).

The Agency Engineer LLC makes no warranties or representations, express or implied, regarding any results you may achieve. You accept full responsibility for all business outcomes, risks, and liabilities that may result from implementing our strategies, campaigns, or recommendations.

18. Testimonials and Case Studies Disclaimer

Any testimonials, case studies, or client examples displayed on our Site represent individual experiences and outcomes. These are not guarantees, and results will vary for each client. The Agency Engineer LLC does not warrant that you will achieve similar outcomes.

19. No Warranty Disclaimer
